Welcome to Hedgeness! These Terms of Use (“Terms”) govern your access to and use of the Hedgeness calculator suite and related services (collectively, the “Services”). By subscribing, accessing, or using our Services, you agree to these Terms and our Privacy Policy. 

If you are entering into these Terms on behalf of a firm or organization, you represent that you have the authority to bind that entity.

1. Our Services

Hedgeness provides embeddable, web-based financial calculators designed for professional financial advisors and firms. 

Each subscription currently includes six calculators branded for your firm (logo, colors, and name), along with lead analytics access and setup/onboarding support. The exact features and number of calculators included may vary by subscription plan or promotional offer. 

Delivery typically occurs within one week after we receive all required branding details and approvals from your firm. Timelines may vary based on responsiveness or customization needs.

2. License and Use

You receive a non-exclusive, non-transferable, limited license to embed and use the calculators on your firm’s website and in your digital communications (such as email or presentations). 

You may not resell, sublicense, or share the calculators with any other firm or entity. 
You agree not to copy, modify, reverse-engineer, or create derivative works of the calculators or Hedgeness platform. 

Hedgeness retains all ownership and intellectual property rights in the Services, software, and content. 

No Guarantee of Uptime: 
Hedgeness does not warrant that the Services will be error-free or uninterrupted, or that they will operate with any specific browser, system, or integration. 

3. Payment and Renewal

Subscription fee: $999 USD per year (billed annually). 
Payment is due in full before delivery and setup. 

Subscriptions automatically renew annually unless canceled in writing at least 30 days before the renewal date. You will receive advance notice of renewal and any price changes before your renewal date. You may cancel at any time before renewal takes effect by emailing admin@hedgeness.com. 

All payments are processed securely via Stripe.

4. Refunds and Cancellations

Because setup and branding work begin promptly after payment, subscriptions are non-refundable once setup has started. 

Exceptions may be made for: 

• Duplicate or erroneous charges 

• Failure to deliver the calculators due to a technical issue on our side 

Refund requests must be made in writing to admin@hedgeness.com within 30 days of payment. Refunds, if approved, will be processed to the original payment method. 

Chargebacks or payment disputes initiated after setup begins are prohibited and may result in account suspension. 

5. Onboarding and Support

After payment, Hedgeness will contact you to collect your firm’s branding information (logo, colors, etc.). 

Standard onboarding includes: 

• Branding and configuration of calculators 

• Delivery of embeddable code snippets 

• Email support during setup 

We respond to most support inquiries within one business day.

6. Data and Privacy

Hedgeness does not collect or store personally identifiable client data from your calculators unless explicitly agreed otherwise. 

You are responsible for complying with applicable privacy and data protection laws for any information gathered through your website.

7. Disclaimers

The calculators are for educational and illustrative purposes only and are not financial or investment advice. 

Hedgeness does not guarantee specific business outcomes, lead volume, or conversion results. 

The Services are provided “as is,” without warranties of any kind, express or implied.

8. Limitation of Liability

To the fullest extent permitted by law, Hedgeness and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, revenue, or data, arising out of or related to your use of the Services. 

Total aggregate liability under these Terms shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

9. Termination

Hedgeness may suspend or terminate your access to the Services if you violate these Terms or misuse the product. 
Upon termination, your license to use and embed the calculators will immediately cease. 

10. Changes to the Terms

We may update these Terms from time to time. Updated versions will be posted at hedgeness.com/retirement-calculators-terms-of-use 

Continued use of the Services after updates constitutes acceptance of the new Terms. 

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. 

Any disputes shall be resolved exclusively in state or federal courts located in Delaware.

13. Miscellaneous

Acceptable Use: 
You may not use the Services for unlawful purposes or to interfere with the operation of the Hedgeness platform. 

Force Majeure: 
Hedgeness will not be responsible for delays or failures caused by events beyond its reasonable control, including internet outages, natural disasters, or governmental actions. 

Entire Agreement: 
These Terms, together with our Privacy Policy and any order confirmation, form the entire agreement between you and Hedgeness. 

Severability: 
If any provision of these Terms is held invalid or unenforceable, the remainder will continue in effect.
