Welcome to Hedgeness. These Terms of Use (“Terms”) govern your access to and use of Hedgeness Local SEO services and related support, reporting, recommendations, and deliverables collectively referred to as the “Services.” 

By subscribing to, purchasing, accessing, or using the Services, you agree to these Terms and our Privacy Policy. 

If you are entering into these Terms on behalf of a firm, business, or organization, you represent that you have the authority to bind that entity. 

1. Our Services

Hedgeness provides Local SEO services designed to help financial advisors and professional service firms improve their local search presence, Google Business Profile performance, local keyword visibility, review systems, and ongoing local search competitiveness. 

The Services may include, depending on the applicable engagement or subscription: 

• Local SEO audit  

• Google Business Profile review and optimization  

• Competitor analysis  

• Local keyword strategy  

• Google Business Profile category, service, description, hours, and business information optimization  

• Review strategy development  

• Review request workflow recommendations  

• Email or SMS review request template recommendations  

• Review response strategy  

• Website Local SEO analysis and recommendations  

• Google Business Profile posting guidance  

• Photo, branding, and profile credibility recommendations  

• Local ranking, visibility, calls, clicks, review, and engagement tracking  

• Monthly reporting and strategic recommendations  

• Ongoing Local SEO management and optimization  

The exact scope, deliverables, meeting cadence, and service level may vary based on the plan, proposal, order confirmation, payment page, or written agreement applicable to your subscription. 

The Services are an ongoing monthly service. Local search visibility may change over time based on competition, proximity, Google algorithm changes, profile activity, reviews, website signals, and other factors outside Hedgeness’s control. 

2. Client Responsibilities

You agree to provide timely and accurate information needed for Hedgeness to perform the Services, which may include: 

• Business name, address, phone number, website, and service area information  

• Google Business Profile access or ownership permissions  

• Branding assets, logo, photos, and service descriptions  

• Compliance requirements or restrictions applicable to your firm  

• Approved language, disclosures, or content guidelines  

• Website access or relevant website information, if needed  

• Feedback, approvals, and responses reasonably required to perform the Services  

You are responsible for ensuring that all information you provide to Hedgeness is accurate, complete, compliant, and authorized for use. 

You are also responsible for reviewing and approving any public-facing content, business descriptions, review request language, posts, responses, website recommendations, or other materials before publication or use, unless otherwise agreed in writing. 

3. Access and Authorization

To perform the Services, Hedgeness may request access to your Google Business Profile, website analytics, website content management system, local listing information, reporting tools, or other relevant platforms. 

You authorize Hedgeness to access and use such accounts solely as needed to provide the Services. 

You remain responsible for maintaining ownership and administrative control of your business accounts. Hedgeness does not claim ownership of your Google Business Profile, website, reviews, business listings, or other client-owned digital assets. 

You agree not to provide Hedgeness with access credentials or permissions that you are not authorized to share. 

4. Payment and Renewal

Unless otherwise stated in a separate order confirmation, payment page, proposal, or written agreement, the subscription fee for the Hedgeness Local SEO service is: 

$399 USD per month 

Payment is due monthly in advance. 

All payments are processed securely through Hedgeness’s payment processor, which may include Stripe or another third-party payment provider. 

Your subscription automatically renews monthly unless canceled in accordance with these Terms. 

Hedgeness may update pricing or plan terms from time to time. If pricing changes apply to your subscription, Hedgeness will provide notice before the change takes effect. 

5. Cancellations and Refunds

You may cancel your Local SEO subscription by providing written notice to Hedgeness at: 

admin@hedgeness.com 

Unless otherwise stated in writing, cancellation will take effect at the end of the then-current monthly billing period. 

Because Local SEO work involves strategy, review, optimization, reporting, account analysis, and ongoing management, fees already paid are non-refundable once the monthly service period has begun. 

Exceptions may be made for: 

• Duplicate or erroneous charges  

• Failure by Hedgeness to begin the Services due to an issue solely on our side  

Refund requests must be made in writing to admin@hedgeness.com within 30 days of payment. Refunds, if approved, will be processed to the original payment method. 

Chargebacks or payment disputes initiated after Services have begun may result in suspension or termination of Services. 

6. Onboarding and Support

After payment, Hedgeness will contact you to begin onboarding. 

Standard onboarding may include: 

• Confirming Google Business Profile access  

• Collecting business and service information  

• Reviewing branding assets and photos  

• Identifying compliance considerations  

• Establishing baseline Local SEO performance metrics  

• Beginning audit and optimization work  

During the first month, Hedgeness may provide a more frequent meeting cadence to support onboarding, audit review, and roadmap implementation. 

Ongoing service may include periodic strategy meetings, reporting, review, recommendations, and continuous Local SEO optimization. 

Hedgeness responds to most support inquiries within one business day. 

7. Compliance and Review Responsibilities

The Services may involve business descriptions, service descriptions, review request workflows, review response recommendations, Google Business Profile content, website recommendations, and other public-facing marketing or business information. 

You are solely responsible for determining whether any content, review process, testimonial-related activity, advertising language, disclosure, or marketing practice complies with laws, regulations, platform rules, professional standards, broker-dealer requirements, RIA compliance policies, insurance requirements, SEC rules, FINRA rules, state regulations, or any other rules applicable to your business. 

Hedgeness does not provide legal, regulatory, compliance, financial, tax, investment, or advertising compliance advice. 

You should obtain approval from your compliance, legal, supervisory, broker-dealer, RIA, or other applicable review function before using or publishing any materials where required. 

8. Reviews and Testimonials

The Services may include review strategy development, review request workflow recommendations, direct review link guidance, review response strategy, and review monitoring. 

Hedgeness does not guarantee that any customer, client, prospect, or third party will leave a review. 

You are responsible for ensuring that any review request, testimonial, endorsement, rating, review response, or related activity complies with applicable law, platform policies, and your firm’s compliance requirements. 

You agree not to request, publish, suppress, alter, fabricate, incentivize, or selectively solicit reviews in any way that violates applicable rules, laws, or platform policies. 

9. Data and Privacy

Hedgeness may receive or access business information, Google Business Profile data, website performance data, analytics data, call/click metrics, ranking information, review information, and related Local SEO performance data in connection with the Services. 

You are responsible for complying with applicable privacy and data protection laws for any information collected through your website, Google Business Profile, forms, analytics tools, call tracking systems, or other platforms. 

You agree not to provide Hedgeness with sensitive personal information, confidential client information, or non-public financial information unless specifically agreed in writing.

10. No Guarantee of Rankings, Leads, or Business Outcomes

Local SEO results depend on many factors outside Hedgeness’s control, including but not limited to: 

• Searcher location and proximity  

• Google algorithm changes  

• Competitor activity  

• Existing website authority  

• Business category competitiveness  

• Review volume, quality, and recency  

• Client responsiveness  

• Compliance restrictions  

• Website structure and technical limitations  

• Market conditions  

• User behavior  

Hedgeness does not guarantee specific rankings, Google Map Pack placement, lead volume, calls, clicks, website traffic, review growth, revenue, conversion rates, or business outcomes. 

Any examples, projections, benchmarks, or performance discussions are illustrative only and do not guarantee future results. 

11. Third-Party Platforms

The Services may rely on third-party platforms, including but not limited to Google Business Profile, Google Search, Google Maps, Google Analytics, Google Search Console, Localo, website platforms, analytics platforms, and other third-party tools. 

Hedgeness does not control third-party platforms and is not responsible for changes, errors, suspensions, outages, ranking changes, policy changes, account restrictions, data limitations, or access issues caused by any third-party platform. 

Your use of third-party platforms is subject to the terms, policies, and rules of those platforms.  

12. Intellectual Property

Hedgeness retains all ownership and intellectual property rights in its processes, frameworks, templates, systems, methods, reports, recommendations, analysis structures, software, tools, documentation, and other proprietary materials used to provide the Services. 

You retain ownership of your business name, logo, website content, photos, brand assets, Google Business Profile, business listings, and client-provided materials. 

Subject to your payment of applicable fees, Hedgeness grants you a limited, non-exclusive, non-transferable license to use final deliverables created specifically for your business as part of the Services. 

You may not resell, sublicense, copy, distribute, reverse-engineer, or create derivative commercial offerings based on Hedgeness’s Local SEO methods, templates, reports, systems, or proprietary materials. 

13. Acceptable Use

You agree not to use the Services for unlawful, misleading, deceptive, fraudulent, abusive, or prohibited purposes. 

You may not use the Services to: 

• Misrepresent your business, services, credentials, locations, or affiliations  

• Publish false, misleading, or non-compliant content  

• Manipulate reviews or ratings in violation of platform rules  

• Interfere with Hedgeness systems or third-party platforms  

• Provide unauthorized access to third-party accounts  

• Violate applicable laws, regulations, platform policies, or professional standards  

Hedgeness may suspend or terminate Services if we reasonably believe the Services are being used in a prohibited or non-compliant manner. 

14. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise. 

Hedgeness disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. 

Hedgeness does not warrant that the Services will be uninterrupted, error-free, or produce any specific result. 

Hedgeness does not provide legal, compliance, financial, tax, investment, marketing compliance, or regulatory advice. 

15. Limitation of Liability

To the fullest extent permitted by law, Hedgeness and its officers, directors, employees, contractors, agents, affiliates, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, ranking changes, review changes, platform restrictions, or reputational harm arising out of or related to your use of the Services. 

Hedgeness’s total aggregate liability under these Terms shall not exceed the amount you paid to Hedgeness for the Local SEO Services in the three months preceding the claim. 

16. Termination

Hedgeness may suspend or terminate your access to the Services if: 

• You fail to pay applicable fees  

• You violate these Terms  

• You misuse the Services  

• You provide false or misleading information  

• You request or require activity that Hedgeness reasonably believes may violate laws, regulations, platform policies, or compliance requirements  

• Continued provision of the Services creates legal, operational, security, reputational, or compliance risk  

Upon termination, Hedgeness will stop providing ongoing Local SEO Services. You remain responsible for fees incurred before termination. 

17. Changes to the Terms

Hedgeness may update these Terms from time to time. Updated versions will be posted on the Hedgeness website. 

Continued use of the Services after updates are posted constitutes acceptance of the revised Terms. 

18. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. 

Any disputes shall be resolved exclusively in the state or federal courts located in Delaware. 

19. Force Majeure

Hedgeness will not be responsible for delays, interruptions, or failures caused by events beyond its reasonable control, including internet outages, third-party platform outages, Google changes, natural disasters, governmental actions, labor disruptions, cyberattacks, hosting failures, or other events outside Hedgeness’s reasonable control. 

20. Entire Agreement

These Terms, together with our Privacy Policy and any applicable proposal, order confirmation, payment page, or written agreement, form the entire agreement between you and Hedgeness regarding the Services. 

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect.
